Acceptable Use Policy

This Acceptable Use Policy (“Policy”) forms part of your agreement with Earnly Ltd (“Earnly”, “we”, “our”, “us”) under the Terms of Service.

Any capitalised terms not defined in this Policy have the meanings set out in the Terms of Service.

1. General Use

You agree not to, and not to permit any third party to, use the Earnly platform (“Platform”) in a manner that:

  • Violates any applicable law or regulation

  • Infringes the rights of others

  • Compromises the security, integrity, or availability of the Platform

  • Misuses financial data or platform outputs

2. Prohibited Use

2.1 Unlawful or Harmful Activity

You must not use the Platform to:

  • Violate, encourage, or facilitate the violation of any law or regulation

  • Infringe intellectual property rights or privacy rights of others

  • Engage in fraud, financial crime, or deceptive practices

  • Misrepresent financial information or impersonate another person

2.2 Misuse of Financial Data and Outputs

You must not:

  • Use data obtained through the Platform for unlawful purposes

  • Manipulate, distort, or intentionally misclassify financial information

  • Rely on Platform outputs as a substitute for professional advice

  • Use the Platform to generate or support misleading financial or tax positions

2.3 Platform Abuse and Security Violations

You must not:

  • Attempt to gain unauthorised access to any system, account, or data

  • Circumvent authentication, access controls, or security measures

  • Introduce malware, viruses, or other harmful code

  • Interfere with or disrupt the Platform or underlying infrastructure

  • Conduct denial-of-service attacks or similar activities

2.4 Data Extraction and Exploitation

You must not:

  • Scrape, harvest, or extract data from the Platform without permission

  • Use automated tools to access or overload the Platform

  • Reverse engineer, decompile, or attempt to derive source code

2.5 Competing Use

You must not:

  • Use the Platform to build, develop, or train competing products or services

  • Replicate or exploit Earnly’s features, data models, or outputs

2.6 High-Risk Financial or Regulatory Use

You must not use the Platform:

  • As the sole basis for filing tax returns or determining statutory obligations

  • To make automated decisions that materially affect financial, legal, or regulatory outcomes without independent verification

  • In any way that could result in harm to individuals through reliance on inaccurate or incomplete outputs

2.7 Misuse of Open Banking Access

You must not:

  • Connect accounts you are not authorised to access

  • Attempt to bypass Open Banking consent mechanisms

  • Use Open Banking data for any unauthorised or unlawful purpose

3. Security and Integrity

You agree not to compromise the security or integrity of:

  • The Platform

  • Other users

  • Third-party systems connected to Earnly

This includes any attempt to probe, scan, or test vulnerabilities without authorisation.

4. Monitoring and Enforcement

Earnly reserves the right to:

  • Monitor usage to detect breaches of this Policy

  • Investigate suspected violations

  • Take action without prior notice where necessary

#5. Enforcement Actions

Where a breach of this Policy occurs, Earnly may:

  • Suspend or terminate access to the Platform

  • Restrict or remove access to certain features

  • Report unlawful activity to relevant authorities

  • Take legal action where appropriate

6. User Responsibility and Indemnity

You are responsible for your use of the Platform.

You agree to indemnify and hold harmless Earnly against any claims, losses, or damages arising from:

  • Your breach of this Policy

  • Misuse of the Platform

  • Unlawful or unauthorised use of financial data

7. Regulatory and Geographic Use

You agree to comply with all applicable laws and regulations in your jurisdiction when using the Platform.

Where use of the Platform involves financial data or tax-related outputs, you must ensure that:

  • Outputs are independently verified

  • Appropriate professional advice is obtained where required

8. Changes to This Policy

Earnly may update this Policy from time to time.

Continued use of the Platform constitutes acceptance of any updated terms.
